PENEGAKAN HUKUM PIDANA TERHADAP PELAKU PENGRUSAKAN SARANA BANTU NAVIGASI PELAYARAN (SBNP) DI WILAYAH DISTRIK NAVIGASI KELAS III PONTIANAK BERDASARKAN PASAL 174 JO. PASAL 316 UNDANG-UNDANG NOMOR 17 TAHUN 2008 TENTANG PELAYARAN
Abstract
ABSTRAK Tesis ini membahas tentang penegakan hukum pidana terhadap pelaku pengrusakan Sarana Bantu Navigasi Pelayaran (SBNP) di wilayah Distrik Navigasi Kelas III Pontianak berdasarkan Pasal 174 jo. Pasal 316 Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran. Di samping itu juga mempunyai tujuan yaitu untuk mengungkapkan dan menganalisis faktor-faktor yang mempengaruhi tidak dilakukannya penegakan hukum pidana terhadap pelaku pengrusakan Sarana Bantu Navigasi Pelayaran (SBNP) di wilayah Distrik Navigasi Kelas III Pontianak berdasarkan Pasal 174 jo. Pasal 316 Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran, dan upaya penegakan hukum pidana terhadap pelaku pengrusakan Sarana Bantu Navigasi Pelayaran (SBNP) di wilayah Distrik Navigasi Kelas III Pontianak berdasarkan Pasal 174 jo. Pasal 316 Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran di masa yang akan datang. Melalui studi kepustakaan dengan menggunakan metode pendekatan hukum empiris diperoleh kesimpulan, bahwa faktor-faktor yang mempengaruhi tidak dilakukannya proses penegakan hukum pidana terhadap pelaku pengrusakan Sarana Bantu Navigasi Pelayaran (SBNP) di wilayah Distrik Navigasi Kelas III Pontianak adalah: (a) Tidak diketahuinya pelaku pengrusakan Sarana Bantu Navigasi Pelayaran (SBNP); (b) Luasnya wilayah kerja Distrik Navigasi Kelas III Pontianak; dan (c) Kurangnya jumlah sumber daya manusia yang melakukan penjagaan terhadap Sarana Bantu Navigasi Pelayaran (SBNP). Adapun upaya penegakan hukum pidana terhadap pelaku pengrusakan Sarana Bantu Navigasi Pelayaran (SBNP) di wilayah Distrik Navigasi Kelas III Pontianak berdasarkan Pasal 174 jo. Pasal 316 Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran di masa yang akan datang dengan cara: (a) Mengambil tindakan yang tegas terhadap pelaku pengrusakan Sarana Bantu Navigasi Pelayaran (SBNP) di wilayah Distrik Navigasi Kelas III Pontianak dengan memproses secara hukum berdasarkan Pasal 174 jo. Pasal 316 Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran agar pelaku pengrusakan Sarana Bantu Navigasi Pelayaran (SBNP) tidak dapat lolos dari jerat hukum; dan (b) Menambah sarana pemantau dan pengawas berupa kamera visual di setiap Sarana Bantu Navigasi Pelayaran (SBNP) untuk mengetahui secara jelas pelaku pengrusakan Sarana Bantu Navigasi Pelayaran (SBNP) di wilayah Distrik Navigasi Kelas III Pontianak agar dapat ditangkap dan diproses secara hukum berdasarkan Pasal 174 jo. Pasal 316 Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran.

ABSTRACT
This thesis discusses the enforcement of criminal law against perpetrators of Destruction of Sailing Navigation Support Facility (SNSF) in Pontianak Class III Navigation District based on Article 174 jo. Article 316 of Law Number 17 Year 2008 concerning Shipping. In addition it also has a purpose that is to disclose and analyze the factors that influence the non-enforcement of criminal law against the perpetrators of destruction of the Sailing Navigation Support Facility (SNSF) in Pontianak Class III Navigation District pursuant to Article 174 jo. Article 316 of Law Number 17 Year 2008 concerning Shipping, and the enforcement of criminal law against the perpetrators of the Destruction of Sailing Navigation Support Facility (SNSF) in Pontianak Class III Navigation District under Article 174 jo. Article 316 of Law Number 17 Year 2008 regarding the Sailing in the future. Through the literature study using the empirical legal approach method, it can be concluded that the factors that influence the criminal law enforcement process against the perpetrators of destruction of Sailing Navigation Support Facility (SNSF) in Pontianak Class III Navigation District are: (a) Not knowing the perpetrators of destruction Sailing Navigation Supporting Facilities (SNSF); (b) The extent of the working area of Pontianak Class III Navigation District; and (c) Lack of human resources guarding the Sailing Navigation Support Facility (SNSF). The criminal law enforcement efforts against the perpetrators of the Destruction of Sailing Navigation Support Facility (SNSF) in Pontianak Class III Navigation District pursuant to Article 174 jo. Article 316 of Law Number 17 Year 2008 regarding Future Shipping by: (a) Takes strict action against the perpetrator of destruction of Sailing Navigation Support Facility (SNSF) in Pontianak Class III Navigation District by processing in law based on Article 174 jo. Article 316 of Law Number 17 Year 2008 concerning Shipping in order that the perpetrators of the Destruction of Sailing Navigation Support Facility (SNSF) can not escape legal harassment; and (b) Adding monitoring and monitoring facilities in the form of visual cameras in every Sailing Navigation Support Facility (SNSF) to know clearly the perpetrators of the Destruction of Sailing Navigation Support Facility (SNSF) in Pontianak Class III Navigation District area to be arrested and processed by law under Article 174 jo. Article 316 of Law Number 17 Year 2008 concerning Shipping.
